About Copyright

Copyright protects the creator of an original work from unauthorized use, including reproduction, distribution, public display, or creating derivative works. This protection applies to nearly all forms of creative expression, such as artwork, photographs, illustrations, designs, text, logos, and other visual content.

Icy Studios allows users to upload artwork and design files to create custom products. However, users are fully responsible for ensuring that any content they upload does not infringe upon the rights of others. This includes copyrights, trademarks, patents, rights of publicity, or any other form of intellectual property.

By submitting artwork or files to Icy Studios, you confirm that:

  • You own or have obtained all necessary licenses, permissions, and rights to use the content;

  • The content does not infringe upon or violate any third-party rights;

  • You understand that Icy Studios is not liable for any damages, claims, or disputes arising from user-submitted materials.

If infringing content is discovered or reported, Icy Studios reserves the right to remove the material and refuse production of any items that may violate another party’s rights.

Filing a Takedown Notice

Icy Studios complies with the U.S. Digital Millennium Copyright Act (DMCA), which provides for the removal of infringing materials.

If you believe your work has been used without authorization, you may submit a DMCA Takedown Notice to info@icystudios.com. Please review whether the use of your work may be protected under fair use before submitting a claim. Submitting a false or misleading claim may result in legal and financial liability.

Your DMCA notice must include the following:

  1. Identification of the copyrighted work claimed to have been infringed, and a copy or proof of ownership (such as registration documentation, if available).

  2. A link or detailed description of the allegedly infringing content.

  3. Your name, address, email address, and a statement that you are the copyright owner or authorized to act on behalf of the owner.

  4. A statement, made under penalty of perjury, that:

    • The information provided is accurate; and

    • You are the copyright owner or authorized representative and have not authorized the use of the material.

  5. An electronic or physical signature.

Once your notice is received, Icy Studios will review and respond within 10 business days. The user responsible for the uploaded content will be notified and given an opportunity to respond.

Icy Studios may remove the material in question, suspend related projects, and, in cases of repeated infringement, terminate the offending user’s account.

Filing a Counter-Notice

If you receive a takedown notification but believe it was made in error or that you have the legal right to use the content, you may submit a Counter-Notice to info@icystudios.com.

Your Counter-Notice must include:

  1. Identification of the material that was removed and its prior location.

  2. A statement under penalty of perjury that you believe the material was removed due to mistake or misidentification.

  3. Your name, address, and email address.

  4. A statement consenting to the jurisdiction of the Federal District Court for your area (or, if outside the U.S., to the jurisdiction where Icy Studios is located) and agreeing to accept service of process from the original complainant.

  5. Supporting evidence of your right to use the content.

  6. An electronic or physical signature.

If your Counter-Notice meets the requirements of applicable law, Icy Studios will forward it to the original complainant. If the complainant does not file a court action within 14 days, your content may be restored, provided it complies with our Terms of Service and related policies.

Please note that submitting a fraudulent or bad-faith counter-notice can result in legal consequences.

Miscellaneous

  1. Policy Updates: Icy Studios reserves the right to modify this Intellectual Property Policy at any time. The updated version will be posted on our website, and the “Last Updated” date will reflect the revision. Continued use of our services after updates indicates your acceptance of the revised policy.

  2. Severability: If any provision of this policy is found invalid or unenforceable, the remaining provisions will continue in effect.

  3. Entire Agreement: This policy constitutes the entire agreement between you and Icy Studios regarding intellectual property matters and supersedes prior communications.

  4. Rights of Publicity: You may not use another person’s name, image, likeness, or other identifiable attributes without their express consent.

  5. Good Faith Use: Users must respect intellectual property rights and ensure all designs comply with applicable laws before uploading content to Icy Studios.
